TERMS OF SERVICE

1. Acceptance of Terms

By accessing and using the Fit4Tennis service operated by Tennis Beast LLC d/b/a Fit4Tennis ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

FIT4TENNIS provides tennis-specific fitness and conditioning programs, including:

• On-demand workout videos and training programs
• Workout and lesson access according to your current plan
• Saved workouts and training history where available
• Fitness Score, Match Prep, and Coach Chat for eligible plans
• Account, billing, and privacy controls

3. Minors & Eligibility

Users under 18: A Fit4Tennis account is created and held by an adult. Any existing junior account stays under its parent or guardian’s controls.

Users under 13 (COPPA): The Service is not directed at children under 13 years of age. If you are under 13, you may only use the Service if a parent or legal guardian has provided verifiable consent in accordance with our Children’s Privacy Notice (COPPA). We do not knowingly allow users under 13 to create accounts without such consent. If we become aware that a child under 13 has created an account without verifiable parental consent, we will delete the account and associated data.

Parents or guardians who believe their child has registered without consent should contact us at privacy@fit4tennis.com.

4. Account Registration

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Subscription Plans and Billing

Free Access and Paid-Plan Trial: The permanent Free plan does not require a payment method. A separate 14-day subscription trial begins only when you review the displayed paid plan, provide a payment method, and confirm on the secure checkout page. The exact price and renewal terms are shown before you confirm. Historical promotional access, when displayed in Account Billing, keeps its existing expiration and does not itself create a new subscription.

Subscription Fees: Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated in our Refund Policy.

Automatic Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

Price Changes: We reserve the right to change subscription fees with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new price.

6. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period.

7. User Conduct

You agree not to:

• Share your account credentials with others
• Download, copy, or redistribute content without authorization
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any portion of the Service
• Use automated systems to access the Service without permission

8. Intellectual Property

All content on FIT4TENNIS, including videos, programs, text, graphics, logos, and software, is the property of Tennis Beast LLC d/b/a Fit4Tennis or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without explicit written permission.

9. Medical Disclaimer

IMPORTANT: The fitness programs and advice provided by Tennis Beast LLC d/b/a Fit4Tennis are for educational and informational purposes only. They are not intended as medical advice or as a substitute for professional medical consultation.

Before beginning any exercise program, you should consult with your physician or healthcare provider. Tennis Beast LLC d/b/a Fit4Tennis is not responsible for any injuries or health problems that may result from your use of the Service.

By using the Service, you acknowledge that physical exercise involves inherent risks and you assume all risks associated with your participation.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TENNIS BEAST LLC D/B/A FIT4TENNIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute that is not resolved informally will be heard in the state or federal courts located in Orange County, California, and you and Fit4Tennis agree to that venue. Nothing in this section takes away any protection you have under the consumer laws of the place where you live.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
